A woman accused of carrying out a violent antisemitic attack aboard a crowded New York City subway train has been granted a bond significantly lower than what prosecutors sought, reigniting concerns about public safety and hate crimes in the city.
Forty-five-year-old Diana Smith appeared in court on Monday to answer charges linked to an incident that allegedly unfolded on May 31.
Prosecutors have charged Smith with felony assault, harassment, and criminal obstruction of breathing, all classified as hate crimes.
She entered a plea of not guilty during the hearing.
The court appearance took place remotely while Smith remained under psychiatric care at Bellevue Hospital.
Prosecutors argued that a $30,000 bond was appropriate given the seriousness of the allegations, while her attorney pushed for her release without bail, claiming she lacked the financial means to pay.
Ultimately, Judge Dan Quart ordered a $10,000 bond, striking a middle ground between the two requests.
Alleged Target Says Harassment Began Moments After Boarding
According to the victim, a 23-year-old Orthodox Jewish woman originally from Montreal and currently living on Manhattan’s Upper West Side, the confrontation started almost immediately after Smith entered the subway car.
The young woman said she had only been on the train for a single stop when Smith boarded around mid-afternoon and allegedly began directing hostile remarks toward her.
What began as verbal harassment quickly escalated into a frightening encounter that left the victim injured and shaken.
The victim, who asked that her name not be published, recalled Smith allegedly making comments about being able to recognize Jewish people.
When she responded to the remarks, the exchange allegedly became even more aggressive.
Video Captures Disturbing Antisemitic Remarks
As the confrontation intensified, the victim decided to record the incident on her phone.
Footage later reviewed by media outlets shows Smith standing inside the subway car while repeatedly making inflammatory statements about Jewish people.
The victim said the comments were directed specifically at her after Smith identified her as Jewish.
In the recording, Smith can be heard making bizarre and offensive accusations while smiling and continuing to focus her attention on the young woman.
Other passengers appeared visibly alarmed as the situation unfolded.
Witnesses on the train could be heard reacting with concern, while some attempted to calm Smith.
Despite those efforts, the verbal abuse reportedly continued.
Violence Allegedly Escalated Beyond What Was Captured on Camera
The recorded footage ended after Smith allegedly knocked the victim’s phone from her hand.
What happened afterward was not documented on video, but the victim described a far more violent assault.
She told investigators that Smith allegedly grabbed her by the throat, kicked her, and forced her to the floor.
During the struggle, Smith is also accused of pulling the victim’s hair with such force that a noticeable clump was torn from her scalp.
The young woman later reported suffering a concussion in addition to the physical injuries caused by the attack.
Photographs taken after the incident reportedly showed both the missing patch of hair and the hair that had allegedly been ripped from her head.
Victim Says Passengers Reacted Too Late
One of the most painful aspects of the ordeal, according to the victim, was the feeling that help did not arrive quickly enough.
She said fellow passengers eventually expressed concern and offered support after the incident, but she believes intervention should have happened much earlier while the confrontation was escalating.
The victim managed to leave the train at the next station and alerted police.
Another passenger reportedly activated the emergency system, helping authorities respond.
Smith was arrested shortly afterward.
Reflecting on the encounter, the woman described feeling shocked that such an attack could happen in a city known for its large Jewish population.
Incident Occurs Amid Ongoing Concerns Over Antisemitic Violence
The subway assault comes against the backdrop of rising concern over antisemitic incidents reported across New York City and other parts of the United States since Hamas’ October 7, 2023 attack on Israel.
Adding another layer of attention to the case, the alleged attack occurred on the same day thousands of people gathered for New York City’s annual Israel Day Parade along Fifth Avenue.
The victim linked the assault to what she views as a broader failure to adequately address growing hostility toward Jewish communities.
She also criticized city leadership, pointing specifically to Mayor Zohran Mamdani, who did not attend the Israel Day Parade.
His absence drew attention because he became the first New York City mayor in more than six decades not to participate in the event.
As the criminal case moves forward, the subway attack continues to fuel discussions about hate crimes, public safety, and the response of authorities to antisemitic incidents in one of America’s largest cities.
