The preliminary hearing for 23-year-old Tyler Robinson, who is accused of fatally shooting conservative activist Charlie Kirk, began Monday under heightened security in Utah, marking the first time Kirk’s immediate family has shared a courtroom with the man charged in his death.
Prosecutors are seeking the death penalty and are expected to argue that sufficient evidence exists for Robinson to stand trial on aggravated murder and several additional criminal charges connected to the September 10, 2025, shooting.
Robinson has not yet entered a plea, and his legal team has not publicly addressed the allegations regarding his guilt or innocence.
Donald Trump Jr. Makes Unexpected Court Appearance
One of the day’s biggest surprises came when Donald Trump Jr. arrived at the courthouse to observe the proceedings.
Trump Jr. had maintained a close relationship with Charlie Kirk, previously describing him as “like a brother.”
He also delivered remarks at Kirk’s funeral following the activist’s death.
Months later, in December 2025, he and Kirk’s widow, Erika Kirk, appeared together as featured speakers during the Turning Point USA conference in Phoenix.
His appearance underscored the continued political significance of the case and drew attention from those gathered outside the courthouse.
Charlie Kirk’s Family Faces the Accused
The emotional weight of the hearing was evident as Charlie Kirk’s parents, Robert and Kathryn Kirk, attended court together for a rare public appearance.
Seated a short distance behind them, Erika Kirk struggled to contain her emotions throughout the opening proceedings.
She was seen wiping away tears with a handkerchief and leaned on her mother-in-law for comfort as testimony began.
The hearing represents the family’s first face-to-face encounter in court with Robinson since Kirk was killed last year.
Prosecutors Outline Serious Charges
Robinson is facing multiple criminal counts stemming from the fatal shooting at Utah Valley University, where prosecutors allege Kirk was addressing a large Turning Point USA gathering attended by thousands of people.
The charges include aggravated murder, felony firearm discharge causing serious bodily injury, two counts of obstruction of justice, two counts of witness tampering, and a misdemeanor allegation of committing a violent offense in the presence of a child.
Authorities allege Robinson surrendered shortly after the shooting and later sent a text message to his partner confessing to the crime and explaining his motive.
Those allegations are expected to form part of the prosecution’s evidence as the case moves forward.
Officer Describes Chaos After the Shooting
The prosecution’s first witness was Spanish Fork Police Officer Chris Bagley, who was assigned to Utah Valley University when the shooting occurred.
Bagley testified that Charlie Kirk was responding to a question from the audience when a gunshot suddenly rang out.
He recalled seeing panic spread through the crowd as people rushed away from the scene while law enforcement officers worked to secure the area.
According to Bagley, after learning that a suspect had been taken into custody, officers shifted their attention toward identifying anyone who might have been injured while also preserving the crime scene for investigators.
During the testimony, Robinson sat quietly in court wearing a beige shirt, occasionally writing notes with a red pen as the officer described the university campus and the sequence of events.
Graphic Evidence Scheduled for Presentation
Later in the hearing, prosecutors are expected to introduce several graphic photographs taken after the fatal shooting.
To protect the public from viewing the disturbing material, courtroom monitors will be positioned so that cameras cannot capture the images.
Members of Charlie Kirk’s family will also receive advance notice before the photographs are displayed.
The evidence is expected to play a central role in prosecutors’ effort to convince the judge that the case should proceed to trial.
Tight Security Surrounds Courthouse
Security around the Fourth District Courthouse was significantly increased for the opening day of the hearing.
Reports indicated Robinson was transported to court in an armored vehicle while law enforcement maintained a heavy presence around the courthouse amid gatherings of both supporters and protesters.
The preliminary hearing is scheduled to continue over five days as prosecutors present witness testimony and evidence supporting their request to move the capital murder case to trial.
