Kentucky Man Sentenced to 40 Years After Fatal Police Chase Kills 10-Year-Old Boy Heading Out for Birthday Shopping

A Kentucky court has sentenced 26-year-old Tymetrius Walter to 40 years in prison after a high-speed police chase ended in a devastating crash that claimed the life of 10-year-old Jake Luxemberg and seriously injured the boy’s grandmother.

Walter received the sentence on Wednesday after pleading guilty to multiple charges, including vehicular homicide, assault, possession of stolen property, and fleeing law enforcement.

Prosecutors had originally charged him with murder, but the offense was later reduced to vehicular homicide as part of a plea agreement.

Attempted Traffic Stop Escalated Into Deadly Collision

The fatal incident occurred in 2023 when a Kentucky State Police trooper attempted to stop Walter during a traffic stop.

Rather than pulling over, authorities said Walter accelerated and fled at a high rate of speed.

As officers pursued the vehicle, investigators determined it had been reported stolen.

The chase continued until Walter exited Interstate 71 and entered Kentucky Highway 329, where his vehicle slammed into a white GMC SUV driven by Teri Portnoy.

The violent collision killed Jake, who was riding with his grandmother, and left Portnoy with significant injuries.

Family Was Celebrating an Upcoming Birthday

Jake’s death was especially heartbreaking because he had been eagerly looking forward to celebrating his birthday.

The 10-year-old was only nine days away from turning 11 and had spent the morning excited about a shopping trip.

His grandmother, who had traveled from Florida to celebrate with him, was taking him shopping when the crash occurred.

Speaking during the sentencing hearing, Jake’s mother, Kathryn Luxemburger, recalled the final conversation she shared with her son before he left the house.

She remembered reminding him not to buy another sweatshirt because he already owned plenty.

Jake cheerfully responded, “Love you, Mom,” to which she answered, “I love you too, buddy.”

Those would become the last words they ever exchanged.

Grandmother Describes the Horrific Moments After Impact

Teri Portnoy delivered an emotional victim impact statement, describing the terrifying moments before and after the crash.

She recalled that Jake had been happily opening a new pack of football cards and joking with her as they drove together.

Moments later, Walter’s vehicle struck their SUV.

Portnoy said she regained consciousness lying in severe pain and initially struggled to understand what had happened.

Broken glass covered the vehicle after it slid to a stop.

She then saw Jake’s hand fall in front of her and noticed his fingernails beginning to turn blue.

Calling out to her grandson, she repeatedly asked him to respond, but he remained silent.

The memory, she told the court, continues to haunt her.

Mother Tells Defendant the Family’s Loss Is Permanent

During the hearing, Jake’s family addressed Walter directly, emphasizing that his decision to flee police forever changed their lives.

Kathryn told the court that Walter consciously chose to prioritize escaping arrest over the safety of everyone sharing the road.

She acknowledged that one day Walter would complete his prison sentence and have the chance to rebuild his life.

Jake, she said, would never receive that opportunity, adding that while Walter’s punishment has an end, her family’s grief is lifelong.

Defendant Offers Apology Before Sentencing

Walter addressed the courtroom before the sentence was imposed, apologizing to Jake’s family for the tragedy.

He admitted that his actions caused immense pain and said the day of the collision had also changed his own life.

While acknowledging that his words could never erase the family’s suffering, Walter expressed remorse for the decisions that led to the fatal crash.

The court ultimately imposed a 40-year prison sentence, bringing the criminal proceedings to a close while leaving a family to continue grieving the loss of a child whose birthday celebration never came.
