Tyler Robinson’s defense attorney has faced criticism after making a pointed remark about Charlie Kirk’s widow, Erika Kirk, during a major pre-trial evidence hearing in Utah.
Michael Burt made the comment while arguing against the public release of certain evidence connected to the assassination case, claiming that widespread access to details could influence a future jury pool.
The defense attorney said Erika had been “very adept at holding press conferences” where she had discussed details surrounding the investigation, a statement that immediately drew condemnation from those representing the Kirk family.
Lawyer Argues Public Release of Evidence Could Affect Jury Selection
The dispute arose as the Kirk family pushed for greater transparency in Robinson’s upcoming legal proceedings.
Family representatives urged the court to release unredacted versions of evidence, witness statements and surveillance footage presented by prosecutors, arguing that the public had a right to see the material.
Burt opposed that request, warning that releasing sensitive evidence could make it more difficult to find an impartial jury if the case proceeds to trial.
During his argument, he referenced Erika Kirk’s public appearances following her husband’s death.
“I want to point out to the court, Ms. Kirk has been very adept at holding press conferences in which she has revealed evidence,” Burt said.
He added that Erika had suggested the state was acting as her legal representative and argued she was “perfectly free” to publicly discuss what prosecutors believed the evidence showed.

Twiggs said he did not hear from Robinson again until later that night, when Robinson allegedly instructed him to look beneath his keyboard, where he found a handwritten note.
Court filings stated the note allegedly contained a message saying Robinson had the opportunity to kill Kirk and intended to do so.
Twiggs told investigators that Robinson returned home the following morning and appeared anxious, pacing around the house while avoiding questions about the killing.
He later claimed Robinson confessed, became emotional and said he regretted what had happened.

The testimony from Twiggs also created emotional moments for both families.
When Twiggs discussed alleged engravings found on bullet casings and said Robinson had used a Dremel tool connected to hunting activities, members of Robinson’s family reportedly reacted strongly.
