A legal battle is unfolding over a devastating accident at a popular Cornwall holiday park, where a young girl suffered life-changing injuries after falling from a low wall.
Her family is now pursuing compensation exceeding £1 million, arguing that the site operator failed to take reasonable steps to prevent a foreseeable danger.
Accident Left Four-Year-Old With Severe Head Injuries
The incident happened in October 2019 at Perran Sands Holiday Park in Perranporth, operated by Haven Leisure.
The girl, who was just four years old at the time and is now nine, fell backward from the wall onto ground approximately 1.5 meters below.
The fall resulted in a fractured skull and a brain hemorrhage, leaving her with a traumatic brain injury that has become the focus of the family’s legal claim.
Mother Alleges Safety Failures by Holiday Park Operator
According to court filings, the girl’s mother believes Haven Leisure failed to properly identify and address the risks posed by the wall.
She argues that the company did not carry out an adequate safety assessment and should have taken precautions, such as installing protective barriers or displaying warning notices to discourage climbing.
The claim alleges that these measures could have prevented the accident from happening.
Dispute Over How the Child Reached the Wall
One of the central disagreements in the case concerns the moments leading up to the fall.
Court documents indicate that nobody witnessed the child climbing onto the wall, which measured less than 50 centimeters high on one side.
Haven Leisure has reportedly argued that the girl’s stepfather placed her on top of the wall before the accident occurred.
However, the family firmly rejects that account, maintaining that the allegation is inaccurate.
Warning Signs Added Following the Incident
After the accident, warning notices stating, “Please do not climb on this wall,” were installed at the location.
The addition of the signs has become part of the broader legal dispute, with the family arguing that earlier safety measures may have reduced the risk of such an incident.
Compensation Claim Could Increase in the Future
The girl’s mother is seeking provisional damages of more than £1 million.
This type of claim would allow the family to seek additional compensation later if the child’s medical condition deteriorates or if further complications linked to her brain injury emerge.
Haven Leisure has not publicly addressed the allegations and has declined to comment while the legal proceedings continue.
