The lawsuit was brought forward by the Peoples Democratic Party (PDP), alleging that Senator Kashim Shettima had been nominated for two positions simultaneously.

The PDP claimed that Shettima’s nomination as Tinubu’s running mate was a violation of several sections of the Electoral Act, 2022, including sections 29(1), 33, 35, and 84(1)(2).

According to the opposition party, Shettima’s simultaneous nomination for the vice-presidential position and the Borno Central senatorial seat was against the law.

However, in a sitting on Friday, a five-member panel of the Supreme Court ruled that the PDP did not have the legal standing (locus standi) to initiate the lawsuit.

The panel clarified that the PDP is not a member of the APC, and therefore lacked the necessary grounds to bring the case forward.
