Bethany Michel moved into her father’s home at Arbor Mill, a retirement community near Jacksonville, six years ago to care for him as he battled a terminal illness.

According to Michel, her father had always intended for her to keep the property, telling her that improvements made to the home were meant for her future.

The conflict began only months after her father’s death when Michel received notice that she no longer qualified to live in the neighborhood because she did not meet its age requirements.

Arbor Mill operates as a 55-and-over community under the federal Housing for Older Persons Act, which allows certain residential developments to limit occupancy based on age.

Community rules require at least one resident in each home to be 55 or older while prohibiting anyone under the age of 19 from living in the neighborhood.

Michel argues that because she had legally lived in the home while caring for her father, she should have been allowed to remain under what she believes is a grandfathered arrangement.

Social Media Campaign Brings National Attention

As the legal dispute continued, Michel turned to social media to publicize her case.

With more than 75,000 followers on TikTok, she posted videos explaining the dispute and urging supporters to raise awareness.

In her videos, Michel alleged that the HOA was attempting to pressure her financially by requiring residents to contribute toward legal costs connected to the case.

She described the move as an effort to force her from the property she now owns.

Residents Face Proposed $1,000 Assessment

The controversy intensified after residents received notice of a proposed special assessment.

According to Michel, every homeowner in the 155-home community was asked to pay a mandatory $1,000 fee, which she believes is intended to cover the HOA’s legal expenses in its efforts to enforce the community’s age restrictions.

She also claimed residents were informed that failure to pay by August 30 would result in an additional $100 being added to their monthly HOA fees over the following 10 months.

A notice later reported by local media stated that the special assessment would fund legal services related to defending and enforcing the association’s status as a 55+ community under state and federal law.

Some Neighbors Rally Behind Michel

The legal battle has reportedly divided opinions within Arbor Mill, although some residents have publicly expressed support for Michel.

Resident William Baltaza said he believes many homeowners would rather see Michel remain in the neighborhood than pay the proposed assessment.

He argued that removing her from the community was unfair and suggested that only a small number of people were pushing for her departure.

Michel has also argued that many residents, most of whom are retirees living on fixed incomes, should not have to shoulder significant legal expenses connected to the dispute.

Board Vote Draws Criticism

Residents gathered for a community meeting this week expecting to vote on the proposed assessment, according to Michel.

However, she later said the decision rested solely with the five-member HOA board.

In an update shared on Instagram, Michel claimed residents waited outside for nearly two hours in Florida’s summer heat believing they would have a say, only to discover they would not be voting on the measure.

She also criticized the meeting process, saying homeowners were only permitted to make comments rather than participate in the decision-making process.

Legal Fight Continues

Michel says she remains determined to challenge the HOA’s efforts and continue fighting to keep the home she shared with her father.

She has called for greater transparency from the association regarding decisions that affect residents’ finances and believes the dispute extends beyond her own situation to broader questions about governance within homeowners’ associations.

While one stage of the assessment process has concluded, Michel insists her legal challenge is far from over.
