James Gibson Murder Case Stalls as Accused Becomes No. 85 in Psychiatric Assessment Queue

The murder case against Johannesburg man James Gibson has been delayed by another legal hurdle, with the accused reportedly waiting for a psychiatric evaluation connected to additional charges brought against him.

Gibson, 29, is accused of murdering his mother, Celeste Antiga, 57, in Bassonia in July.

However, his case cannot progress while investigators and the courts await outstanding reports and the psychiatric assessment linked to the separate matter.

Gibson Reportedly 85th on Assessment Waiting List

Gibson is reportedly number 85 on a waiting list for a psychiatric bed where the assessment is expected to take place.

The assessment relates to two charges recently added to the proceedings: assault with intent to do grievous bodily harm and contravening a domestic violence order.

The development highlights the delays that can arise when accused people require specialist psychiatric assessments before criminal proceedings can move forward.

Two Additional Charges Added to Case

Gibson appeared before Magistrate Shumani Oriel Vele at the Booysens Magistrate’s Court in Johannesburg South.

The two additional charges originate from a separate district court matter in which Gibson had previously appeared, according to the Southern Courier.

The court postponed both matters until 29 October, when they are expected to be consolidated so they can be dealt with together.

The murder proceedings are also awaiting important documentation from investigators.

Police Still Await Key Investigation Reports

The State is reportedly still waiting for the crime-scene photo album and the post-mortem report relating to Antiga’s death.

Until those documents are available, the prosecution process cannot proceed to the next stage.

The outstanding reports, combined with the psychiatric assessment, have therefore created further delays in a case that has already attracted significant attention.

Antiga Died After Being Found Seriously Injured

The alleged murder occurred at a property in Blouklip Avenue, Bassonia, on the evening of 14 July.

According to police, the incident was reported at approximately 19:10 after Antiga was allegedly found unconscious and covered in blood.

She had suffered severe injuries to her upper body and was taken to hospital for treatment.

She died the following day, on 15 July.

Gibson Was Arrested Days After the Incident

Police allege that Gibson left the scene following the incident and remained at large for several days.

He was eventually arrested on 21 July and detained at Mondeor Police Station.

Gibson is facing a Schedule 6 murder charge under South Africa’s Criminal Procedure Act of 1977.

The classification carries a particularly demanding bail threshold, requiring an accused seeking release to demonstrate that exceptional circumstances exist which justify bail in the interests of justice.

Accused Has Previously Said He Wants to Plead Guilty

The case took another unexpected turn during Gibson’s appearance on 31 August when he reportedly told the court that he wanted to plead guilty to the murder charge.

Magistrate Hasina Habib explained that the court must follow the required legal procedure before a formal guilty plea can be accepted.

She also directed the State to move the process forward.

Despite Gibson’s reported intention to plead guilty, no formal plea had been entered at the time of the latest report.

October Court Date Could Bring Multiple Matters Together

The next significant date in the case is 29 October.

The two separate matters are expected to be consolidated, while the State continues working to obtain the outstanding investigative reports and arrange the psychiatric assessment.

Until those steps are completed, the murder case remains unable to move into its next stage.

Gibson remains in custody and, as an accused person, is presumed innocent until proven guilty. He is expected back before the Booysens Magistrate’s Court on 29 October.
