Delayed Justice Sparks Terrorism Allegations from Nnamdi Kanu’s Family
The family of detained IPOB leader Nnamdi Kanu has expressed deep concern over the prolonged delay in obtaining the Certified True Copy (CTC) of the Supreme Court judgment related to his case.
Speaking through Kanunta Kanu, the family asserted that the delay signifies an endorsement of terrorism within the judicial system, presidency, and the Nigerian entity, as per the country’s laws.
CTC Delay Seen as a Deliberate Attempt to Hinder Legal Proceedings
Kanunta Kanu emphasized that the deliberate withholding of the CTC, a month after the Supreme Court’s ruling on December 15, 2023, is impeding the family’s efforts to pursue justice for Nnamdi Kanu.
The refusal to release the judgment copy raises suspicions of foul play, with the family accusing the Nigerian government of violating the principles of the rule of law.
Supreme Court’s Decision Adds Complexity to Nnamdi Kanu’s Legal Battle
Recalling the Supreme Court’s decision that rejected the Appeal Court’s ruling for Nnamdi Kanu’s immediate release, the family contends that returning the case to a lower court of appropriate jurisdiction adds complexity to the legal proceedings.
The refusal to provide the CTC further complicates matters, hindering the family’s legal moves to seek justice for their son.
Allegations of Terrorism Against Nigerian Authorities
Kanunta Kanu cited Section 2 (3)(f) of the Terrorism (Prevention & Prohibition) Act, 2022, asserting that the actions of the judiciary, presidency, and the Nigerian entity align with the definition of terrorism.
The family argues that unlawfully withholding the CTC violates Nigeria’s treaty obligations, making the authorities officially terrorists under the country’s laws.
Legal Perspective: Terrorism Act Implications
Referring to the Terrorism (Prevention & Prohibition) Act, Kanu emphasized that the deliberate acts of withholding information related to Nnamdi Kanu’s case, with the intention of furthering a particular ideology, qualify as acts of terrorism.
The family’s accusations underscore the gravity of the situation and its potential implications on the rule of law in Nigeria.
