The Federal High Court Abuja has sentenced Babagana Habeeb to 10 years in prison for aiding terrorist activities.

The judgment was delivered on Friday in Abuja by Justice Peter Lifu, following a one-count charge brought by the Federal Government.

Court Convicts Babagana Habeeb for Supplying Fuel to Insurgents in North-East Nigeria

Habeeb, a fuel dealer based in Maiduguri, was found guilty of aiding terrorism through the supply of petroleum products to insurgents operating in Nigeria’s North-East region.

During arraignment, he pleaded guilty to selling fuel in the area but argued that some transactions may have been carried out by his station attendants without his direct knowledge.

Prosecutor Argues Fuel Supply Enabled Terrorist Attacks Across North-East Nigeria

Prosecuting counsel, David Kaswe, opposed leniency and urged the court to impose a stricter 20-year sentence.

He told the court that fuel supplied to insurgents played a critical role in facilitating attacks, enabling mobility and escape into remote areas, which contributed to deaths and displacement in affected communities.

Court Notes Lack of Evidence Linking Habeeb to Terrorist Membership or Training

In his ruling, Justice Lifu stated that there was no evidence showing that Habeeb was a member of any terrorist group or had undergone training.

The judge clarified that the conviction was based solely on the established offence of supplying fuel to insurgents, which constituted aiding and abetting terrorism.

Babagana Habeeb Appeals for Mercy Citing Family and Prolonged Detention

During the proceedings, Habeeb pleaded for leniency, kneeling in court and asking for mercy. He told the court he has two wives and six children and had been in detention for over 10 years without contact with his family.

The court also acknowledged that the prosecution did not dispute the claim regarding his prolonged detention.

Court Orders Sentence to Begin from Arrest Date and Directs Immediate Release After Term

Justice Lifu ruled that the 10-year sentence would take effect from the date of Habeeb’s arrest and detention.

Given the time already spent in custody, the court directed that he be released immediately after completing formalities, including signing his release warrant, to allow for rehabilitation.

Impact and Consequences of Terrorism Conviction in Nigeria’s North-East Region

The case highlights ongoing concerns about indirect support systems that sustain insurgent activities in Nigeria’s North-East.

It also underscores the legal risks faced by individuals whose actions—whether direct or indirect—contribute to the operations of armed groups, particularly in conflict-affected regions.

What’s Next After Federal High Court Judgment in Abuja?

Following the ruling, Habeeb is expected to be released after administrative procedures are completed, given that his sentence has effectively been served.

Authorities may continue monitoring and prosecuting similar cases involving logistical support to insurgents as part of broader counter-terrorism efforts.
