Depp has returned to the witness stand for cross-examination.
Depp is back on the stand for cross-examination now that the court has returned from lunch.
The judge refers to Depp’s counsel as “snarky,” eliciting chuckles from the audience.
Judge Azcarate labeled Depp’s lawyer Benjamin Chew “snarky” just before the hearing adjourned for lunch, causing the crowd to erupt in laughter.
The moment came at the end of hearing an emergency motion to intervene filed by TMZ. The motion was to prevent a former employee from testifying in the Johnny Depp and Amber Heard defamation case.
The judge denied the motion.
Depp’s lawyer Chew had previously said that TMZ was not comparable to major news outlets like New York Times.
He later noted to Tobin that he was not trying to be ‘snarky.’
The judge interrupts and says: ‘You’re just a snarky guy.
In a resurfaced interview with Vanity Fair, Kate Moss said Johnny Depp was only one who knew how to look after her.
‘There’s nobody that’s ever really been able to take care of me,’ she said. ‘Johnny did for a bit. I believed what he said. Like if I said, ‘What do I do?,’ he’d tell me. And that’s what I missed when I left. I really lost that gauge of somebody I could trust. Nightmare. Years and years of crying. Oh, the tears!’
The British supermodel said the actor, with whom she was in a relationship from 1994 to 1998, had not ‘pushed, kicked or threw me’ down any stairs while they were together.
Moss denied the allegations made by Heard who had said she heard a rumor that Depp had pushed Moss down a flight of stairs.
Moss said the rumor was not true and that Depp had come to her aid.
‘No, he never pushed me, kicked me or threw me down any stairs,’ she said.
Depp called Heard’s accusations of sexual and physical abuse ‘insane’ Wednesday as he was back on the stand.
‘Ridiculous, humiliating, ludicrous, painful, savage, unbelievably brutal, cruel, and all false,” Depp said when asked about his reaction to hearing Heard’s allegations when she testified earlier in the trial.
Depp was testifying Wednesday as a rebuttal witness.
‘I have never in my life committed sexual battery, physical abuse, all these outlandish, outrageous stories of me committing these things,’ he said. ‘And living with it for six years, and waiting to be able to bring the truth out.’
He said that ‘no matter what happens I did get here and I did tell the truth and I have spoken up for what I’ve been carrying on my back, reluctantly, for six years.’
Depp will be cross-examined Wednesday afternoon.
Judge Penney Azcarate is now hearing an emergency motion to intervene filed by TMZ to prevent a former employee from testifying in the Johnny Depp and Amber Heard defamation case
‘We’re seeking to intervene simply to protect the relationship between reporters and their sources,’ Charles Tobin said.
Tobin said former TMZ employee Morgan Tremaine is under subpoena.
Depp’s lawyer Benjamin Chew said Tremaine was not subpoenaed and will testify on his free will. He asks the judge to deny TMZ’s emergency motion.
Judge Azcarate denies TMZ’s emergency motion.
Court is taking a one hour lunch break and will return at 2 p.m. ET
Depp is expected to return to the stand for cross-examination when court reconvenes.
Depp gave some specific responses to some of the particular allegations levied by Heard and also her sister, Whitney Henriquez, who provided some of Heard’s strongest corroborating testimony last week.
Henriquez had previously testified that she was at the penthouse with Heard and Depp during a fight. She said Depp struck her in the back and Heard then hit Depp.
But Depp argued Wednesday that Heard unleased her abuse not only on him, but also on her sister.
He told the court that he recalled seeing Heard grab her sister Whitney Henriquez and ‘push her around.’
Henriquez took the stand last week and testified that when she first met Depp around 2012 he was ‘bright and beautiful and lovely and kind and generous.’
But if Depp was drinking or using drugs there was ‘almost always a fight.’
Depp claims he’d never heard the rumor that he pushed his ex-girlfriend Kate Moss down stairs in Jamaica until Amber Heard ‘spewed it three times’ in court.
‘Ms Heard took the story and turned it into a very ugly incident, all in her mind,’ Depp said.
Depp said he never heard the rumor before Heard ‘grabbed hold of it.’
Depp recalled the incident in Jamaica when Moss slipped. Depp was outside of their bungalow to wait for her when it started to downpour.
He saw her walk out and slip down a set of three wooden stairs onto her back. She was ‘obviously in pain,’ Depp said, and he ran over to make sure she was OK.
Moss revealed in testimony Wednesday morning that she slipped and that Depp never pushed her.
‘He never pushed me, kicked me or threw me down any stairs,’ she said.
Depp returned to the stand later Wednesday morning and said he had previously told Heard the story of how Moss slipped. But said he had not heard the rumor until she brought it up in court.

Depp said Heard hit him on their honeymoon while on the Orient Express in 2016.
A photo was shown in court of Depp and Heard posing with the staff on the Orient Express. Depp said he had a ‘shiner.’
‘I had a sort of shiner, but it all ended and everything got fine again. We’d go to dinner,’ he said.
He said at time, things were ‘agreeable’ and ‘nice’ but then there were times when ‘something had become dissatisfactory’ for Heard and she would ‘start the rant.’
When asked how he got the black eye, Heard’s team objected.
It was overruled and Depp said, ‘Miss Heard hit me, is that better?’
Kate Moss told Johnny Depp’s $100million defamation trial that he never pushed her down the stairs.
Moss, appearing briefly via live video from Gloucestershire, England, said that while on vacation in Jamaica she slipped and Depp came to her aid.
Moss said that throughout the court of their relationship (1994-1998), ‘He never pushed me, kicked me or threw me down any stairs.’
Depp admits he’s taken MDMA ‘six or seven times’ in his life but denies to ever having taken 10 pills at once because ‘I’d probably die,’ he said.
Depp described the incident of his severed fingertip that happened in Australia.
He testified that Heard threw the first vodka bottle which went over his head.
The second bottle that was thrown hit his hand that was resting on the bar. The bottle severed his fingertip, he said.
‘She had thrown a bottle of vodka and smashed my, smashed and cut my finger off,’ Depp said. ‘The tip of my finger, but a good chunk. I miss it.’
A photo of text is shown. Depp said: ‘This is my text to Dr. Kipper, who had just happened to be in town. Telling him that I’ve had it and that I just lost a finger, a fingertip.’

Johnny Depp is the next witness called to the stand Wednesday.
It came after conflicting reports of which day the 58-year-old actor would take the stand, or whether it would happen at all.
Depp’s lawyer Jessica Meyers asks Depp the date of when he first saw the ‘Waldman Statements.’
Depp said he saw them in August 2020, during the same time of the counterclaim suit.
Meyers asks Depp if he remembers the part of Heard’s testimony where she claims Depp did not help her get the role of Mera in Aquaman.
‘It’s not exactly true,’ he replied.
Johnny Depp was seen smiling as he watched his ex-girlfriend Kate Moss give her testimony on his behalf during his defamation lawsuit against Amber Heard.
Moss, appearing via live video from Gloucestershire, England, shut down Heard’s claim the 58-year-old actor pushed Moss.
‘He never pushed me, kicked me or threw me down any stairs.’
During Moss’ testimony, Depp gazed at the screen in front of him with a smile on his face.

Dr. Curry told the court on Wednesday that the extreme levels that Heard scored on PTSD indicates feigning of symptoms.
The test results Dr. Hughes presented previously in court were not consistent with PTSD, she argued. But instead, the high levels are more consistent with exaggeration and feigning.
She said there is ‘no evidence’ that Heard has PTSD, adding that PTSD is ‘extremely disabling’ and those who suffer from it are not typically going to events, hosting dinner parties, excelling in their film career.
Curry also added that PTSD cannot be ‘trigged’ if it’s not already there. Hughes had previously claimed that Heard’s PTSD was trigged by the Waldman statements.
Johnny Depp greeted fans from afar as he waved at the screaming crowd and flashed a smile before entering the Fairfax County Courthouse Wednesday morning.
Depp carried his travel coffee thermos, book and cell phone as he walked inside.
He shook hands with a courthouse sheriff and waved once more at his fans.
