Basetsana Kumalo expressed satisfaction following Tuesday’s sentencing announced at the Randburg Magistrates Court against controversial author Katleho Jacqueline “Jackie” Phamotse.
Phamotse was found guilty of defaming Kumalo, a prominent entrepreneur and former beauty queen.
Phamotse’s Sentencing
According to TshisaLIVE, Jackie Phamotse received a two-year house arrest sentence, along with a fine and unpaid community service.
This verdict stemmed from Phamotse’s defamatory allegations against Basetsana Kumalo, made via a social media platform in 2018.
Allegations of Defamation
Phamotse’s defamatory post insinuated the involvement of Kumalo and her husband Romeo in a purported sex tape, leading to legal repercussions including charges of crimen injuria, criminal defamation, and contempt of court.
Phamotse’s Lack of Remorse
In addition to the social media post, Phamotse reportedly published a book referencing the controversial allegations and case number, demonstrating a lack of remorse for her actions.
Details of the Sentence
During the court proceedings, Magistrate Saras Naidoo imposed a fine of R30,000 on Phamotse, with the alternative of imprisonment.
Phamotse was also ordered to perform 16 hours of community service monthly until the expiration of her sentence.
Additionally, she must undergo assessment by a social worker, participate in a life skills program, and abstain from alcohol and narcotics.
Relief and Restoration for Kumalo
Basetsana Kumalo expressed relief and gratitude, stating that the sentencing allows her family to “move on” and “find peace.”
She emphasized the importance of standing up for one’s rights and dignity, underscoring the victory not only for her family but for all South Africans facing cyberbullying and seeking justice.
Personal Struggles and Redemption
Reflecting on the six-year ordeal, Kumalo acknowledged the difficulty endured by her family, particularly her young children.
However, she expressed gratitude for the opportunity to restore their lives and emphasized the resilience and perseverance necessary to overcome such challenges.
Conclusion
Basetsana Kumalo’s legal victory against Jackie Phamotse underscores the significance of defending one’s reputation and integrity.
The sentencing serves as a reminder of the consequences of cyberbullying and the recourse available through legal avenues for those affected.
