Court Clears Senator For 2023 Election

A Federal High Court sitting in Jalingo has cleared a former acting governor of Taraba State, Senator Sani Abubakar Danladi.

 
The Court declared him fit to contest future elections in the country.

 
Justice Simon Amobeda in his ruling, nullified a previous judgement of 6 March 2019 which disqualified Senator Danladi, a chieftain of the All Progressives Congress APC from participating in the 2019 governorship election and other elections.

 
The rulling states that Danladi now has a jurisdiction to participate in any form of political activities or any of its relation.

 
 
The judgement reads thus:” Wether the federal High court has a jurisdiction to set aside it’s earlier judgement on certificate issues, the presiding judge continue by defining the concept of what jurisdiction is.

 
“He defines jurisdiction in law as the ability to decide or re-decide it’s decision” he further affirmed that the court of Law has a jurisdiction to set aside it’s earlier judgement or make another decision if there was a hole in the the earlier judgement.

 
He therefore reaffirmed that the court has a jurisdiction to set aside it’s earlier judgement and by virtue of the plaintiff Senator Sani Abubakar Danladi has a backing document.

 
The documents was said to be an (Affidavit) that enables him qualify for using his documents and can be used to participate in any form of election.

 
The presiding judge however refers to a case between supreme court Vs Dingyadi INEC Vs Okoro Ugwuanyi and kogi state Vs INEC.

 
The presiding judge rules that “the application by the defendant’s counsel lacks the merits to prove wether the earlier judgement will be set aside, therefore the case was a pre-election matter and this court shouldn’t have attended the case, and the supreme court in its earlier judgement of 2019 has been set aside.

 
 
Counsel to Senator Sani Abubakar Danladi, Barrister David Kashima said the judgment was a victory for the rule of law saying his client does not have any encumbrance from participating in political activities in the country.
