NPA Announces Plan to Appeal Judge Irma Schoeman’s Ruling in Omotoso Case Following Not Guilty Verdict in Gqeberha

In a move that has caught the attention of many, the National Prosecuting Authority (NPA) has decided to challenge the ruling of Judge Irma Schoeman from the Eastern Cape Division of the High Court in Gqeberha.

This decision follows the not guilty verdict in the high-profile case involving Nigerian televangelist Timothy Omotoso and two co-accused individuals.

The three men were acquitted of serious charges, including allegations of rape, racketeering, and human trafficking.

Appeal Decision Based on Legal Review

According to Barry Madolo, the NPA’s Director of Public Prosecutions for the Eastern Cape, the decision to appeal was made after thorough review by senior prosecutors, who also sought an external legal opinion.

Madolo expressed that, despite the complex nature of the legal process, there are reasonable prospects for a successful appeal.

The NPA aims to challenge the judgment, believing that the case warrants further examination.

Clarification of Factual Findings

As part of the appeal process, the NPA has formally filed papers with the Registrar of the High Court in Gqeberha, seeking clarification of the factual findings in the case.

Once these clarifications are received, the NPA’s legal team will move forward with finalizing the papers related to legal questions and formally applying for the reservation of those questions of law.

Internal Investigation Into Prosecutors’ Conduct

In addition to the appeal, the NPA is conducting an internal investigation into the actions of the prosecution team involved in the case, which began back in August 2024.

The inquiry’s scope has now expanded to include both prosecution teams, and the NPA is focused on identifying any individuals whose conduct may warrant disciplinary action.

A report on the findings from this investigation is expected to be ready by June 2025.

Impact on Victims and the Justice System

The NPA has acknowledged the emotional and psychological toll the judgment has had on the victims involved in the case, and it recognizes the blow to public confidence in the justice system, particularly in addressing Sexual and Gender-Based Violence (SGBV).

Despite this setback, the NPA insists that this judgment should not overshadow the vital support the agency continues to provide to SGBV victims, especially in complex cases.

The NPA has made it clear that the decision should not discourage other victims from coming forward, as the agency remains committed to ensuring access to services for all those affected by such crimes.

What Does the Future Hold for the Justice System?

As the NPA moves forward with the appeal and investigations, many are left wondering if this will help restore faith in the justice system, especially regarding its ability to handle sensitive SGBV cases.

The outcome of the appeal could play a significant role in reshaping public perception of how such matters are handled in the future.
