TMZ reports that Haley’s attorney, Matthew Bialick, plans to file a motion to dismiss the lawsuit once formally served.
Bialick argues that it’s unreasonable to hold Haley liable for “exercising her sexual sovereignty by truthfully describing a sexual experience that left her in tears.”
In short, he claims that her freedom to talk about her own sexual experiences—what he calls “erotic autonomy”—should protect her from legal consequences.

On the other side, Matt’s attorney, Ryan Saba, has accused Haley of using the livestream for “fortune and fame.”
Saba claims that her comments were not of legitimate public concern, yet they subjected Matt and his family to ridicule and unwanted attention.
“Her actions were extreme, outrageous, beyond all possible bounds of decency, and have caused substantial harm to Matt Kalil, his family, and his business,” Saba said.
The lawsuit alleges that Matt, who stood 6-foot-6 and weighed 315 pounds during his NFL career, has endured unwanted scrutiny, while Haley may have financially benefited from the attention her comments generated.
Haley Responds: Shocked and Hurt
Haley spoke to TMZ after the lawsuit was filed, saying she was “genuinely shocked and incredibly hurt” by the claims.
She described the litigation as “harrowing and emotionally draining” and expressed heartbreak that the dispute involves both their families.
Haley also noted that she spoke positively about Matt multiple times during the livestream, even calling him “the greatest guy in the world.”

Since their split in 2022, Matt has remarried model Keilani Asmus in the summer of 2024.
According to the lawsuit, Keilani has been targeted with disturbing social media messages about her husband’s private life, some directly referencing Haley’s viral comments.
