Ted Cruz’s Talk with Fox News Host Reveals Plan to Challenge 2020 Results
Sen. Ted Cruz advocated for the establishment of a congressionally appointed electoral commission to assess unsubstantiated claims of voter fraud in the 2020 election before the Jan. 6, 2021, attack on the U.S. Capitol.
Abby Grossberg, a former Fox News producer, recorded Cruz debriefing her and Fox Business host Maria Bartiromo about the creation of an electoral commission that would result from the denial of Joe Biden’s victory on Jan. 6, 2021.
The Washington Post obtained the Jan. 2, 2021, recording from Grossberg’s lawyer.
Cruz was the first senator to object to the electoral college results, joining Rep. Paul A. Gosar (R-Ariz.) in challenging Arizona’s electoral certification.
The recording sheds new light on the extent of Cruz’s efforts to assist Trump in overturning Biden’s victory.
He organized 11 senators to object to the electoral certification as the mechanism to establish a commission, as The Post previously reported.
In the recording, Cruz stated that the commission needs an adjudicatory body with fact-finding and investigative authority to consider the facts, examine the record, and make determinations.
He referenced the commission created in 1877 to investigate voter fraud in the Hayes-Tilden election.
Cruz cast doubt on the Supreme Court’s ultimate determination to reject the lawsuits filed to challenge Trump’s election loss.
Cruz’s plan for an electoral commission involved establishing it if a majority of the House and Senate objected to electoral certification on Jan. 6, 2021.
The commission would commence a 10-day review period to be completed before the inauguration.
If the commission found “credible evidence of fraud that undermines confidence in the electoral results in any given state,” then the state would call a special session and recertify results, according to Cruz.
The plan caught the attention of former President Trump, who tweeted his support.
However, it was criticized by some of Trump’s most loyal allies and some of Cruz’s advisers.
Rep. Jamie Raskin (D-Md.), a member of the House select committee that investigated the Jan. 6 attack, accused Cruz of playing along with Sidney Powell and Rudy Giuliani’s fraud perpetration on the country.
