Mrs Ngozi Olejeme, the former Managing Director of the Nigeria Social Insurance Trust Fund, NSITF, for whom they both stood as sureties, was arrested and incarcerated.
Ubani has maintained his innocence in the case of Olejeme’s disappearance, claiming she fled when the EFCC raided her residence.
He further alleged that he decided to stand surety for Olejeme since he was forced to return to Nigeria to face the allegations against her, and that the EFCC had thwarted all attempts to secure her bail.
Despite Ubani’s explanations, he was arrested and held for 20 days by the EFCC.
Ubani subsequently filed an action before the FCT High Court seeking N5billion exemplary and aggravated damages for the violation of his rights.
Delivering judgment in the suit Wednesday, Justice Sylvanus Oriji declared Ubani’s arrest and subsequent detention for 20 days was illegal and a violation of his right. The judge further ordered the EFCC to pay Ubani 12million as damages.
The judge however refused to order the EFCC to offer a public apology for the illegal detention.
